Terms of Service

1. Acceptance of terms
By creating an account, installing our app, or using our services, you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the service.
2. The service we provide
DigiKhana is a hyperlocal food ordering platform that lets consumers discover and order food from independent restaurants (“Partners”) listed on the platform. GS Tech operates the platform; Partners prepare and (in future versions) riders deliver the food.
3. Your account
- You must be at least 18 years old to create an account.
- You agree to provide accurate, current, and complete information when creating your account and to keep it updated.
- You are responsible for keeping your phone number and login credentials secure. Do not share your OTP codes with anyone.
- You may delete your account at any time from within the app or by contacting info@gstechs.in. See the Privacy Policy for what happens to your data.
4. Acceptable use
You agree not to:
- Use the service for any unlawful purpose or in violation of these Terms.
- Impersonate any person, misrepresent your affiliation, or provide false information.
- Attempt to gain unauthorised access to the service, other accounts, or our systems.
- Interfere with or disrupt the integrity or performance of the service.
- Use the service to harass, abuse, or harm another person or Partner.
- Reverse-engineer, decompile, or attempt to extract source code from the app.
5. Orders and payments
[TODO Phase 1+: Payment terms will be detailed once Razorpay is integrated. v0 is browse-only; no orders or payments are processed through the platform.]
6. Delivery
[TODO Phase 1+: Delivery terms will be detailed once rider operations launch. Estimated delivery times are not guaranteed; the Partner is responsible for food preparation and the rider for transit.]
7. Cancellations and refunds

8. Intellectual property
The DigiKhana brand, logo, app, website, and all content generated by us (excluding Partner-provided menu content) are owned by GS Tech and protected by Indian and international intellectual-property laws. You may not copy, modify, distribute, sell, or lease any part of our services without our prior written consent.
9. Third-party content
Menu items, prices, photos, and descriptions are provided by Partners. We do not warrant the accuracy or completeness of Partner-provided content and are not responsible for it.
10. Disclaimer of warranties
The service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Food quality and food safety are the responsibility of the Partner.
11. Limitation of liability
To the maximum extent permitted by law, GS Tech shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service. Our total liability for any claim arising out of these Terms shall not exceed the amount you paid us in the three (3) months preceding the claim, or ₹1,000, whichever is greater.
12. Indemnification
You agree to indemnify and hold GS Tech, its officers, employees, and agents harmless from any claims, damages, or expenses arising from your violation of these Terms or your misuse of the service.
13. Termination
We may suspend or terminate your access to the service at any time, with or without notice, for any violation of these Terms or for any conduct that we determine in our sole discretion to be harmful to the service or other users.
14. Dispute resolution
Disputes will be resolved by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996, seated in Mathura, Uttar Pradesh.
15. Governing law
These Terms are governed by the laws of India. The courts of Mathura, Uttar Pradesh shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms.
16. Changes to terms
We may modify these Terms at any time. Material changes will be notified in-app or via email. Continued use of the service after changes take effect constitutes acceptance.
